Terms of Service

Banana Studio is an independent product operated by DanDan AI Limited. It is not affiliated with Google, DeepMind, OpenAI, ByteDance, Alibaba, or other model providers unless we expressly say so.

These Terms of Service govern your access to and use of Banana Studio, including the website at imgeditor.co, the web application, and the API (collectively, the "Service"). By using the Service, you agree to these Terms, our Privacy Policy, and our Acceptable Use Policy.

1. Operator and Eligibility

The Service is operated by DanDan AI Limited, a Hong Kong company. You must be legally able to enter into this agreement and use the Service only for lawful business or personal purposes. If you use the Service on behalf of an organization, you confirm that you have the authority to bind that organization to these Terms.

2. Accounts, Credits, and Billing

You are responsible for keeping your account credentials secure and for all activity under your account. You must provide accurate billing and contact information. Paid plans, subscriptions, and credit packs are billed according to the pricing shown at checkout. Except where required by law or expressly stated in our refund policy, purchases are non-refundable.

3. Inputs, Outputs, and Rights

You are responsible for the prompts, uploads, reference media, and other materials you submit to the Service ("Inputs"), as well as the content generated or edited through the Service ("Outputs"). You represent that you have all rights, permissions, and consents needed to use your Inputs and any Outputs you publish or commercialize.

We may process Inputs and Outputs solely as needed to operate, maintain, secure, and improve the Service, investigate abuse, and comply with law.

4. Content Safety and Acceptable Use

You must comply with our Acceptable Use Policy. Banana Studio does not allow the generation, editing, uploading, or distribution of:

  • NSFW, adult, nude, semi-nude, sexually explicit, sexually suggestive, fetish, escort, or pornographic content.
  • Content that sexualizes minors, depicts exploitative sexual behavior, or otherwise violates child safety laws.
  • Non-consensual intimate imagery, sexual deepfakes, or requests to imitate a real person's body or likeness in sexualized contexts.
  • Illegal, fraudulent, defamatory, hateful, violent, or privacy-invasive content.

In particular, NSFW, adult, and sexually explicit content generation is prohibited on Banana Studio. We may use automated filters and manual review to detect violations.

5. Prohibited Conduct

  • Attempt to bypass or weaken safety filters, moderation systems, rate limits, or access controls.
  • Upload inputs or prompts for which you do not have the necessary rights, permissions, or consents.
  • Use the Service to infringe copyrights, trademarks, privacy rights, publicity rights, or any other third-party rights.
  • Resell, scrape, reverse engineer, overload, or disrupt the Service without our written permission.

6. Moderation and Enforcement

We may refuse prompts, block outputs, remove content, suspend access, cancel subscriptions, or investigate accounts where we believe there is a safety, legal, fraud, or policy risk. Violations of these Terms or the Acceptable Use Policy may result in immediate account termination, loss of access to Outputs stored on the Service, and denial of refunds.

7. Third-Party Models and Availability

Banana Studio may route generation requests through third-party model providers and infrastructure partners. Model availability, latency, output quality, and moderation outcomes may change at any time. We do not guarantee that any specific model, provider, feature, or output format will remain available.

8. Disclaimer and Limitation of Liability

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. DanDan AI Limited will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
